Here the Plaintiff files a complaint which outlines the facts to support a particular cause of action. The Defendant then has an opportunity to respond by admitting or denying the allegations in the Complaint. The Defendant also has an opportunity to assert “affirmative defenses.”
The next stage of a civil litigation case is discovery. Discovery usually takes the form of Interrogatories, Requests for Production of Documents, Requests for Admissions, and the taking of Depositions. Anything that is “reasonably calculated to lead to the discovery of admissible evidence” is fair game in discovery.
Usually, the next stage of civil litigation is some form of a settlement conference or mediation ordered by the Court. Here, the parties have completed discovery and they will at least attempt in good faith to resolve the case without further litigation. Litigation is very expensive, time-consuming, and emotionally and physically taxing on all those involved.
The last stage of civil litigation is trying the case before the jury. Now, there is a tremendous amount of work and preparation that occurs in between, but these are just some of the very broad stages of the civil litigation process here in Florida.
